Rule 14
Procedures for Search and Seizure
(1) In the course of investigation and investigation of an offense related to revenue leakage, if the investigating officer has reasonable grounds to suspect that any person or evidence related to such offense is with any person or in any place, before entering any person's house, compound, commercial premises, warehouse, factory or any place Information related to bank search should be given in the format as per schedule-9.
(2) In accordance with sub-rule (1) during the search of the premises, mentioning the details of the items related to the offense of revenue leakage found at that place, the owner of the goods and, if available, the representative of the local body or any government employee and at least two local persons, a seizure bond in the format as per Schedule-10 Will have to prepare.
(3) If the cash, currency or bills, documents or any other goods recovered during the search of the premises according to sub-rule (1) are to be taken with him, the investigating officer shall return such goods in the format as per Schedule-11 to the owner of the related goods or the goods in charge. In the case of individuals and any organized organization, it should be given to the manager or officer or responsible employee of such organization.
(4) If the owner of the seized item refuses to take compensation according to sub-rule (3), such compensation shall be deposited in the name of the representative of the local authority or government employee and at least two local persons as far as available at the place of seizure.
(5) If the representative of the local authority or the government employee and the two local persons as per sub-rule (4) are not found, the employee who will complete the work shall mention the same in the payment slip and deposit such payment at the place where such cash, currency or bills, documents or any other goods have been seized. After doing so, the concerned person shall be deemed to have duly understood the payment.
(6) If the local body representative or any government employee and at least two local people are not available in the search warrant, the team members who go to search the warehouse should be kept on alert and complete the work.
(7) If the concerned person is not found or if he refuses to stay in Rohbar, the same should be mentioned in the warrant.
